A USEFUL STARTING POINT
National importance concerns the potential impact of the specific endeavor. It does not require operating in every state or directly benefiting every American.
EB-2 eligibility comes first
EB-2 is the underlying immigrant category. A national interest waiver, or NIW, is a request to waive the job-offer requirement and, consequently, the labor-certification requirement normally associated with that category. This article addresses the general NIW framework. A strong proposed endeavor does not eliminate the need to establish eligibility as an advanced-degree professional or a person of exceptional ability.
The advanced-degree route can include a qualifying advanced degree or a U.S. bachelor’s degree, or foreign equivalent, followed by at least five years of progressive post-degree experience in the specialty. For an NIW, USCIS also examines the profession underlying the proposed endeavor and the relationship of the qualifying experience to the specialty. The exceptional-ability route has its own evidence requirements and requires expertise significantly above that ordinarily encountered; the claimed ability must relate to the endeavor.
Define the proposed endeavor in concrete terms
The proposed endeavor is the specific work you intend to advance in the United States. A job title such as “coach,” “business owner,” “engineer” or “marketing professional” is too broad to explain it. The petition should identify the problem or need, the activities you will undertake, the intended beneficiaries, the way the work will be implemented, and the evidence supporting its potential impact.
Your professional history remains important because it can show that you are well positioned to carry out the work. But acclaim, a long résumé, or a successful company cannot substitute for explaining the endeavor itself. I begin with your real plans and then examine whether the available facts support the required national-interest analysis.
The three NIW questions
Matter of Dhanasar, 26 I&N Dec. 884, 889 (AAO 2016), establishes three prongs after EB-2 eligibility: “substantial merit and national importance”; whether the person is “well positioned to advance the proposed endeavor”; and whether, “on balance, it would be beneficial to the United States to waive the requirements of a job offer and thus of a labor certification.” Each part requires its own explanation and supporting evidence.
Substantial merit and national importance answer different questions
Substantial merit concerns the value of the proposed work. Under Dhanasar, merit can arise in business, entrepreneurship, science, technology, culture, health, or education. Immediate revenue or a measurable economic return is not mandatory: research or work advancing human knowledge can have substantial merit even before financial benefits can be quantified.
National importance concerns the endeavor’s potential prospective impact and broader implications. Explaining that fitness improves health, education benefits society, or technology supports the economy may establish useful background. The case must still connect the specific proposed work to an impact of national importance. The importance of the profession, industry, or social problem does not automatically establish the importance of every project within it.
Does the work have to reach the whole country?
No. Dhanasar expressly explains: “we do not evaluate prospective impact solely in geographic terms.” A venture focused on one geographic area can have national importance. The question is what the evidence shows about its wider significance. A project operating in several states can still fall short if the petition does not explain the significance of its impact.
Relevant considerations can include broader implications for a field, significant potential to employ U.S. workers or other substantial positive economic effects, particularly in an economically depressed area. These are possible ways to support national importance, not mandatory alternatives or a fixed hiring quota. The evidence must support the particular theory presented.
A practical example for coaches and business owners
Consider a hypothetical plan to open a local BJJ academy. Teaching, serving students, and employing staff may have real value. Those facts alone do not establish the national importance of that particular academy. The inquiry needs to examine the scale and substance of the claimed economic effects or other broader implications, with supporting evidence rather than general statements about the benefits of martial arts.
If the actual endeavor includes an established training approach intended for adoption by other organizations, I would examine evidence of those organizations’ interest, implementation commitments, relevant results, available resources, and a credible route to broader use. Simply calling a program “national,” projecting rapid expansion or describing it as innovative does not establish the legal requirement. This example illustrates questions to investigate, not a formula for qualifying a gym or coaching practice.
Show why you are well positioned
The second prong considers your education, skills, knowledge, record of success in related efforts, plans, progress, and interest from potential customers, users, investors, or other relevant parties. Depending on the endeavor, useful evidence may include completed projects, pilot results, contracts, funding, partnerships, or specific support from people who know the work. A detailed business plan is stronger when its assumptions and commitments can be checked against reliable records.
The law does not require certainty that the endeavor will succeed. Dhanasar recognizes the uncertainty inherent in innovation and entrepreneurship. The requirement is evidence that you are well positioned to advance the endeavor, established under the preponderance standard. That gives room for a credible future project while still requiring more than personal confidence or unsupported predictions.
Explain why the waiver itself benefits the United States
The third prong balances the interests served by labor certification with the benefits supporting a waiver in the individual case. Relevant considerations may include whether the nature of the endeavor makes the usual process impractical, whether the United States would benefit from your contributions even if qualified U.S. workers are available, and whether the national interest warrants proceeding without that process. Showing that you would prefer not to seek an employer sponsor does not complete this analysis.
What current USCIS guidance means for preparation
USCIS’s January 15, 2025 update clarified the underlying EB-2 eligibility inquiry, the relationship between exceptional ability and the endeavor, national importance, and evaluation of evidence such as support letters and business plans. The current published Policy Manual directs attention to what the person will actually do. For a filing prepared today, I focus on a specific endeavor, documented progress and support, credible impact claims, and a separate explanation of each NIW prong.
A change in administration does not turn every locally focused project into an ineligible case, and choosing a popular topic does not create automatic eligibility. I assess the governing requirements against your actual facts and update the strategy when relevant guidance changes. For an initial inquiry, send your education and experience, a short description of the work, its intended impact, and a few supporting links. We can develop the evidence after that first review.
